This privacy policy sets out how Weaver Vale Pilates uses and protects any personal information that you provide to us.

​We respect your privacy and pledge to maintain the confidentiality of your personal information.

Weaver Vale Pilates ("us", "we", or "our") operates a web site at https://weavervalepilates.co.uk (the “Site”).  By our “Service” we mean all related web sites, downloadable software, mobile applications (including tablet applications), and other services provided by us, or any digital media on which a link to this Privacy Policy is displayed, and all other communications with individuals through written or oral means (such as email or phone) directed at accessing or using any service we offer, together with the Site.

 

Our Privacy Policy informs you about our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data.

We may use your data to provide and improve the Service to you. By using the Service, you agree to the collection and use of information in accordance with this policy, and our Terms of Service. This Privacy Policy is incorporated into and subject to our Terms of Service.  Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

1. Key Terms Used in this Privacy Policy

  • “Client” means a customer of Weaver Vale Pilates.

  • “Client Data” means Personal Data a Client provides to use the Service.

  • “Personal Data” means any information relating to an identified or identifiable natural person or considered personally identifiable information by law.

  • “Public Area” means those portions of the Service that can be accessed both by Users and Visitors, without needing to log in.

  • “Restricted Area” means those portions of the Service that can be accessed only by logging in.

  • “User” means a person or entity that uses the Service.

  • “User Data” means Personal Data that a User provides to use the Service.

  • “Visitor” means an individual other than a User, who uses the public area, but has no access to the restricted areas of the Site or Service.

 

2. Information We Collect

2.1 Client and User Provided Information.

We collect information to provide and improve our Service to you.  We sometimes collect Personal Data including:

  • “Registration Information”: When you register to use our Service, you will be asked to complete a registration form.  This form requires providing information such as name, address, phone/fax number, email address and other Personal Data as well as health and medical related information.

  • “Publishing Information“: We also collect information you submit through our Site.

  • “Usage Data“: We may collect information that your browser sends whenever you visit our Service.  This may include information such as your computer's Internet Protocol address (i.e. IP address), browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and the like.  Usage Data may also include data about your purchasing patterns, your contact details, and your profile information.

When you access the Service by or through a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

  • “Payment Information“: We may collect billing information, credit card numbers and expiration dates, tracking information from cheques or money orders, or other payment information particularly if you establish a credit account with us or our providers or if you purchase a product or service from us, or other vendors available through the Site.

  • “Account Activities Information“: We record and retain the records of your Account activities when you use the Service. If you make sale and purchase transactions online through Acuity Scheduling’s web-based transaction platform, we also collect information related to such transactions including the types and specifications of the goods, pricing and delivery information, any trade dispute records.

  • “Statistical Information“: In addition, we gather statistical information about our Site and Users, such as IP addresses, browser software, operating system, software and hardware attributes, pages viewed, number of sessions, unique visitors and so forth.

  • “Marketing Information“: From time to time, we gather information about our Users and prospective users during trade shows, marketing events and other functions for follow up marketing purposes.

  • “Disclosed Personal Information“: From time to time, our Users may disclose Personal Data deliberately or inadvertently including without limitation to personal identifiers such as name, email addresses, telephone number, facsimile number and IP address of individuals in the course of using the Site.

2.2  Information Collected by Clients. 

A User may store or upload data into the Service. Each Client is responsible for providing notice to Users who are its customers and third persons concerning the purpose for which the Client collects their Personal Data and how this Personal Data is processed in or through the Service as part of Client Data.

2.3  Information Collected by Cookies.  We use "cookies" to store specific information about you and track your visits to our Site. It is not uncommon for websites to use cookies to enhance identification of their users. A "cookie" is a small amount of data that is sent to your browser and stored on your computer's hard drive. A cookie can be sent to your computer's hard drive only if you access our Site using the computer. If you do not de-activate or erase the cookie, each time you use the same computer to access our Site, our web servers will be notified of your visit to our Site and in turn we may have knowledge of your visit and the pattern of your usage. We use automatically collected information and other information collected on the Service through cookies and similar technologies to: (i) personalise our Service, such as remembering a User’s or Visitor’s information so that the User or Visitor will not have to re-enter it during a visit or on subsequent visits; (ii) provide customised advertisements, content, and information; (iii) monitor and analyse the effectiveness of Service and third-party marketing activities; (iv) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (v) track your entries, submissions, and status in any promotions or other activities on the Service.

You can determine if and how a cookie will be accepted by configuring your browser, which is installed in the computer you are using to access the Site. If you desire, you can change those configurations in your browser to accept all cookies, to be notified when a cookie is sent, or to reject all cookies. If you reject all cookies you may be required to re-enter your information on our Site more often and certain features of our Site may be unavailable.

2.4  Collected Information.  By “Collected Information” we mean information collected by cookies, information collected by Clients that is provided to us or collected by us as Client Data, Registration Information, Publishing Information, Usage Data, Payment Information, Account Activities Information, Statistical Information, Marketing Information, Disclosed Personal Information and any information we may collect from you, from our affiliates, or from other parties or through any other means.

3. How we Use Collected Information

Weaver Vale Pilates may use the Collected Information for various purposes:

3.1 General: We use your Collected Information to improve our marketing and promotional efforts, to statistically analyse site usage, to improve our content and product offerings and to customise our Site's content, layout and Service specifically for you. We may use your Collected Information to facilitate proper operation of our Service and business activities of its Users including without limitation to facilitation of effective communication between buyers and suppliers and marketing activities of Users. 

We do not otherwise sell, rent, trade or exchange any Personal Data of our Clients, Users or Visitors. Your Collected Information may be transferred, stored, used and processed outside your home jurisdiction. In case of a merger with or transfer of business to another business entity, we will transfer your Collected Information to the entity which acquires the business (Should such a combination occur, we will require that the new combined entity follow this Privacy Policy with respect to your Collected Information).

3.2 Registration Information: We may use your Registration Information to provide services that you request or to contact you regarding additional services about which Weaver Vale Pilates determines that you might be interested. Specifically, we may use your email address, mailing address, phone number, mobile number or fax number to contact you regarding notices, surveys, product alerts, new service or product offerings and communications relevant to your use of our Site. We may generate reports and analysis based on the Registration Information for internal analysis, monitoring and marketing decisions.

3.3 Publishing Information: All of your Publishing Information will be publicly available on the Site and therefore accessible by any internet user. Any Publishing Information that you disclose to Weaver Vale Pilates becomes public information and you relinquish any proprietary rights (including but not limited to the rights of confidentiality and copyrights) in such information. You should exercise caution when deciding to include personal or proprietary information in the Publishing Information that you submit to us.

3.4 Usage Data: We use Usage Data to provide value-added services to our members including without limitation to providing buying pattern and buying behavioral data to our members to facilitate marketing initiatives and decision-making.

3.5 Payment Information: Weaver Vale Pilates uses Acuity Scheduling to book your appointments and they will share your Payment Information with banks or vendors relevant to the transaction in order to enable transactions to be completed. In addition, Acuity Scheduling may use Payment Information to determine your credit-worthiness and, in the process of such determination, Acuity Scheduling may make such Payment Information available to banks or credit agencies. While Acuity Scheduling has in place up-to-date technology and internal procedures to guard your Payment Information against intruders, there is no guarantee that such technology or procedure can eliminate all of the risks of theft, loss or misuse. Both Weaver Vale Pilates and Acuity Scheduling shall not be liable to you or any other person for any damages that might result from unauthorised use, publication, disclosure or any other misuse of Payment Information, including credit card information.

3.6 Account Activities Information: We use Account Activities Information to provide the services that you request. We may also generate reports, statistics and analysis based on Account Activities Information to enhance and improve our Site and services.

4. Disclosure Of Data

4.1 Unrestricted Information.  Any information that you voluntarily choose to include in a Public Area of the Service, will be available to any Visitor or User who has access to that content.

4.2 Disclosure to Service Providers.  We may provide your Collected Information to our affiliates and service providers under contract (such as customer care) to support the operation of the Site and Service. We work with third party service providers who provide website, application development, hosting, maintenance, and other services for us. These third parties may have access to, or process Personal Data or Client Data as part of providing those services for us. We limit the information provided to these service providers to that which is reasonably necessary for them to perform their functions, and our contracts with them require them to maintain the confidentiality of such information.

4.3 Disclosure for Law Enforcement.  Under certain circumstances, Weaver Vale Pilates may be required to disclose or make public Collected Information, including your Personal Data.  For example, we may disclose Personal Data in the good faith belief that such action is necessary to:

  • To comply with a legal obligation, for example in response to a subpoena or other judicial order or when we reasonably believe that such disclosure is required by law, regulation or administrative order of any court, governmental or regulatory authority

  • To protect and defend the rights or property of Weaver Vale Pilates, including to identify, contact or bring legal action against someone who may be infringing or threatening to infringe, or who may otherwise be causing injury to or interference with, the title, rights, interests or property of Weaver Vale Pilates, our Users, Clients, partners, affiliates, Visitors, or anyone else who could be harmed by such activities

  • To prevent or investigate possible wrongdoing in connection with the Service

  • To protect the personal safety of users of the Service or the public

  • To protect against legal liability

  • To pursue a claim or prevent further injury to Weaver Vale Pilates or others if we have reason to believe that a User is in breach of the Terms of Use or any other agreement with us

5. Retention of Data

  • Weaver Vale Pilates will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy or as reasonably necessary to provide, promote and support the Service. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

  • Weaver Vale Pilates will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

6. Transfer Of Data

  • Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your town, city, county, country or other governmental jurisdiction where the data protection laws may differ from those within your jurisdiction.

  • Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

  • Weaver Vale Pilates. will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your Personal Data and other personal information.

7. Security of Data

  • If you are a Client or User who has registered with the Service, your Registration Information, Publishing Information and Payment Information (if any) can be viewed and edited through your Account, which is protected by a Password. We recommend that you do not divulge your Password to anyone. Our personnel will never ask you for your Password in an unsolicited phone call or in an unsolicited e-mail. If you share a computer with others, you should not choose to save your login information (e.g., User ID and Password) on the computer. Remember to sign out of your Account and close your browser window when you have finished your session.  If you are a User or Visitor, please note that no method of transmission over the Internet, wireless transmission, or method of electronic storage is perfectly secure. The security of your data is important to us, and we strive to use commercially acceptable means to protect your Personal Data. However, we cannot guarantee its security.​​

8. Your Rights

Weaver Vale Pilates aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

8.1 Modifying Personal Data.  Whenever made possible, if you have registered to use our Service, you can update your Personal Data directly within your account settings section. If you are unable to change your Personal Data, please contact us to make the required changes.

8.2 Removing Personal Data.  If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems, please contact us.  If you are not a Client or User it is extremely unlikely that we would have your Personal Data.

8.3 Data Portability.  You have the right to data portability for the information you provide to Weaver Vale Pilates. You can request to obtain a copy of your Personal Data in a commonly used electronic format so that you can manage and move it. 

8.4 Other Data Subject Rights.  In certain circumstances, you have the right:

  • To access and receive a copy of the Personal Data we hold about you

  • To rectify any Personal Data held about you that is inaccurate

  • To request the deletion of Personal Data held about you

Please note that our systems are set up so that the Client can respond to requests regarding these rights and you should contact any Client with whom you have shared Personal Data regarding this request. Please also note that you may be asked to verify your identity before receiving a response to such requests.

 

9. Changes To This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the "effective date" at the top of this Privacy Policy.

It is your responsibility to check this page from time to time for any changes to the Privacy Policy and ensure that you are happy with our policy.

Terms And Conditions

​This website is owned and operated by Trinity Therapy with its registered address at Suite G3 Northwich Business Centre, Sheath Street, Northwich, Cheshire, CW9 5BF.

The use of the Website and the purchase of any Products or Services on the Website or in the Studio will be subject to these Terms and Conditions.

Weaver Vale Pilates reserves the right to revoke and/or amend any or all of these Terms and Conditions from time to time when We consider it necessary or desirable for the regulation of the affairs of Our business and the well being of Our Members.

The Terms and Conditions shall be interpreted and governed in accordance with English Law, and You consent to the exclusive jurisdiction of the English courts.

Definitions

In the Terms and Conditions, the following definitions apply:

  • 'Weaver Vale Pilates” – the registered name of the Pilates Studio which We own

  • 'Studio' - the Products, Services, premises and employees associated with Weaver Vale Pilates

  • 'We/Us/Our' - refers to all employees, owners of Weaver Vale Pilates

  • 'You/Your(s)' – any Member(s), client(s), customer(s) that make use of the Products and Services provided by Weaver Vale Pilates

  • 'Member(s)' - anyone who has registered with Us, either on the Website or in person, and in respect of whom the registration has been accepted by the studio

  • 'Product(s)' - item(s) that are offered for sale on the Website or in the Studio itself

  • 'Service(s)' - refers to any Services provided by and/or ordered by clients from Us through the studio or via the website

  • 'Site or Website' - refers to www.weavervalepilates.co.uk URL or Website that We own and administer

  • 'Sessions' – classes, appointments, private and semi private tuition provided by Weaver Vale Pilates.

Session Bookings and Cancellations

All Sessions must be booked and paid for prior to participation in those Sessions. All Sessions can be booked and paid for via the online booking facility on Our Website or by our admin.  

A 24 hour cancellation policy applies. Members will be charged for a Session where cancellation or rescheduling of a Session is not made online or notice of the same is not received. More than 24 hours notice must be given before the start of the Session when cancelling or rescheduling, or you will be charged in full for the Session. Cancelled sessions are not refundable for cash.

All Sessions are booked on a first come first served basis.  

When a Session is booked You will receive a notification confirming the booking and details thereof. Once a Session is confirmed You will be held to the cancellation policy for that Session. 

Sessions are always subject to availability however We will always do our utmost to accommodate you for a chosen Session as per Your request. 

Sessions are sold as single Sessions (Drop ins) or in various pack combinations and monthly membership options. 

Members may not transfer Sessions to any other person or permit them to be used by anyone other than themselves. 

Prices of Products and Services may be increased by us at any time. 

All block booking Sessions are valid for a limited time as stated at purchase. 

A Member who signs up for a monthly membership agrees to a minimum 3 month direct debit commitment. After the 3 month commitment has been fulfilled the direct debit will continue to bill monthly. 

30 days written notice is required from the next direct debit date for cancellation after the initial 3 month commitment. 

Monthly recurring charges will be billed automatically to a valid credit/debit card.

Membership

When a person has completed the Registration Form he/she will become a Member of the Studio.

Any guests brought to the Studio by a Member must ensure that he/she has registered online or completed a registration form at the Studio before the commencement of any Session.

Acceptance of a person as a Member is at the absolute discretion of Weaver Vale Pilates.

Children under the age of 16 years may only become Members of the Studio and attend Sessions with the consent of their parent/guardian and must be accompanied by an adult.

Weaver Vale Pilates reserves the right to refuse entry or expel from the Studio, suspend for a specific period, or refuse to renew the membership of any Member whose conduct is or may, in Our reasonable opinion, be injurious to the character of the Studio or which amounts to a breach of the Terms and Conditions or where such expulsion is otherwise in the interests of the other Members of the Studio.

Any Member so expelled will forthwith cease to be a Member of the Studio and will not be entitled to any refund for any period during which his membership is suspended.

Payment Terms

Details of Session prices, promotional offers and gift certificate prices are available either at www.weavervalepilates.co.uk or directly from Our Studio.

A Member may not attend any Session at the Studio without first booking and paying for the Session.

If no payment is received the Member may not partake in the Session.

Members must keep an active credit or debit card on their online booking profile so that any late cancellations, other purchases and monthly direct debits can be recouped.

Payments for Sessions and gift certificates in any amount are non-refundable unless otherwise stated in the Terms and Conditions.

Missed Sessions are not refundable for cash but can be made up if sufficient notice was given and/or the particular session has no expiry or specified time frame within which it needs to be completed.

Limitation Of Liability

Our Studio reserves the right to make alterations to the Sessions, instructors and/or equipment, provided to Members, without notice and at Our absolute discretion.

We will not be liable for any loss caused by such alterations except insofar as such loss is by law incapable of exclusion.

It is the Member’s responsibility to ensure that he/she is capable of undergoing a routine of exercises provided by any programme which he/she follows or Session which he/she attends.

Members accept the risk of injury from performing exercises and are advised to consult their doctor prior to commencement of any Session or programme.

Weaver Vale Pilates accepts no liability for loss or damage to property of Members or for injury to Members (or yourself) on our Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion.

Health and Fitness

Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition.

All Members must report any injuries before the Session starts.

The Studio reserves the right to refuse access to any Member if, at Our absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.

Members with low/high blood pressure and/or cardiac irregularities should consult his/her doctor before participating in any Session.

Members must notify the Studio of any circumstances affecting their health which may be exacerbated through continued use of the Studio.

Members are required to follow the instructions of the instructor/teacher at all times.

Studio Opening Times

Details of Session times at the Studio may vary from time to time.

Session times will be published by the Studio and will be available either at the Studio or at www.weavervalepilates.co.uk

​​Safety And Hygiene

In the interests of safety and hygiene, no crockery, glass or food is permitted in the Studio.

Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these exits for any reason.

In the event of a fire, members are asked to make their way to the nearest available exit.

Smoking is forbidden in the building.

We have our own separate entrance at the back of the building accessible from the overflow car park; however if you require wheelchair access please use the main entrance.

Shoes are to be removed as you enter the Studio.

Foot hygiene is important to us so clients are requested to wear socks.

Toe socks can be purchased from the front desk if required.

Suggested Dress Code

Members are requested to wear a form of dress appropriate to the practice of Pilates and we recommend that Members wear stretch pants or shorts and a T-shirt or sports top.

Members should attend Sessions in socks.

Registration, Rights and Changes to Contact Details

(see our privacy policy document for further details about privacy and data protection)

 

Members are required to inform the Studio of any changes to their contact details such as home address, email address or mobile phone. Failing such notice, all communications will be assumed to have been received by the Member within five days of mailing or texting to the last address (of either type) provided to the Studio. Weaver Vale Pilates reserves the right to refuse admission to the Studio.

A person who is not a party to the Registration Process has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of the Registration Process.

We may, if a Member so wishes, communicate with the Member by electronic mail (“email”).

By providing an email address to Us, the Member consents to receiving email communications from the Studio, including notices in accordance with the Terms and Conditions.

The Member also accepts the risk that email may not be a secure and confidential means of communication. Weaver Vale Pilates will not be liable for any loss or damage suffered as a result of communicating with a Member by email.

Members must at all times observe the Studio guidelines which may be notified to them from time to time. Members are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Members.

Studio Rules and Regulations

All equipment must be put away at the end of a Session in its designated place.

All surfaces used should be wiped down with the spray and towel provided.

Never use the equipment without an instructor present.

You should arrive at least 5 minutes prior to Sessions starting to sign in either at the front desk or with the instructor. By agreeing to these Terms and Conditions, Members confirm that they have no health problems which may affect their participation in any Session provided by Weaver Vale Pilates. By clicking ‘Book Now’ on the Website you confirm you answer all the health questions with a ‘No’ and that a doctor has confirmed you can take part in a Weaver Vale Pilates session.

Intellectual Property

The content on the Weaver Vale Pilates Website, including without limitation, all content and the like, are owned by Weaver Vale Pilates, subject to copyright and intellectual property rights under the law.

Content on the Website is provided to you for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owner. You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Website or Services, provided by you to us are non-confidential and shall become the sole property of the Weaver Vale Pilates. You agree to not engage in the use, copying, or distribution of any of the content other than expressly permitted herein. You agree not to disable or otherwise interfere with security related features of the website.
